By using or accessing the facilities and services provided by Elements Casino Chilliwack, you ("User") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

DEFINITIONS

The following terms shall have the meanings specified below:

• "User" means any individual who uses or accesses the facilities and services of Elements Casino Chilliwack;
• "Elements Casino Chilliwack" means Well-Established Resort, its owners, employees, agents, and affiliates;
• "Facilities" includes but is not limited to gaming areas, dining establishments, accommodations, entertainment venues, recreational activities, and other amenities provided by Elements Casino Chilliwack.

USE OF FACILITIES

The User shall use the facilities in a responsible manner and adhere to all posted rules, regulations, and instructions provided by Elements Casino Chilliwack's staff or security personnel.

• The User is liable for any damage caused to property, including but not limited to gaming equipment, fixtures, furniture, and other chattels within the premises.
• Users are expected to conduct themselves in an orderly fashion at all times. Any form of unruly behavior may result in expulsion from Elements Casino Chilliwack's facilities.

GAMBLING AND GAMES OF CHANCE

Gambling is subject to Canadian laws, regulations, and provincial gaming policies as they relate to land-based casinos.

• Users must be 19 years or older to participate in any form of gambling at Elements Casino Chilliwack's facilities;
• Gamble responsibly; if you need assistance, please speak with one of our on-site advisors.

DATA COLLECTION AND USE

Elements Casino Chilliwack may collect and use your data in accordance with its privacy policy.

• Elements Casino Chilliwack will not share or distribute user information without explicit consent;

INDEMNIFICATION

The User shall indemnify Elements Casino Chilliwack against any loss or damage arising from the breach, non-performance of obligations by the User under these Terms and Conditions.

SECURITY AND FAIR PLAY

Elements Casino Chilliwack provides secure gaming equipment that employs Random Number Generator (RNG) software.

• All games are subject to fair play principles in accordance with BCLC's regulations;

DISPUTE RESOLUTION

Any disputes arising out of or related to the use of Elements Casino Chilliwack facilities and services will be resolved by binding arbitration according to the rules and procedures of British Columbia Arbitration Act, SBC 1997.

GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed and construed in accordance with British Columbia law.

• Any claims or disputes arising from or related to these Terms and Conditions will be heard and determined by the courts having jurisdiction in British Columbia;

AMENDMENTS TO TERMS AND CONDITIONS

Elements Casino Chilliwack may modify, change or update these Terms and Conditions at its discretion without prior notice.

BREACH OF CONFIDENTIALITY

The User shall not disclose confidential information obtained during their use of Elements Casino Chilliwack's facilities to any third party.

ENTIRE AGREEMENT

These Terms and Conditions constitute the entire agreement between Elements Casino Chilliwack and the User with regards to access and use of its facilities, and supersedes all prior or contemporaneous agreements or understandings.

NULLITY OF PROVISIONS

If any term, covenant or condition contained in these Terms and Conditions becomes illegal or unenforceable under applicable law, that provision shall be removed or replaced by a valid one so as not to affect the other provisions hereof;

NOTICES AND COMMUNICATION

• Any notice given pursuant to this Agreement will be deemed sufficiently served upon personal service of an adult or by prepaid first-class mail;
• Communication is subject to the laws and regulations of Canada, including but not limited to those related to data protection.

ENTIRE AGREEMENT

These Terms and Conditions constitute the entire agreement between Elements Casino Chilliwack and the User with regards to access and use of its facilities and services, and supersedes all prior or contemporaneous agreements or understandings.

By using this facility you agree that these conditions are valid for your visit during which there shall not occur any breach.
